1. The "ZOOM IN ON THE JAZZ FEST" contest
(hereinafter the "Contest") is sponsored by the Festival International de Jazz de
Montréal (hereinafter the "Contest Organizer" in collaboration with L.L.
Lozeau Ltée (hereinafter "L.L. Lozeau"). The Contest begins at 12:00 p.m.
Eastern Daylight Time (EDT) on June 28, 2013 and ends at 11:59 p.m. Eastern Daylight
Time (EDT) on July 4, 2013.
ELIGIBILITY REQUIREMENTS
2. This Contest is open to residents of Canada
who have reached the age of majority in their province or territory of residence.
No purchase is necessary. The Contest is not open to employees of the Festival International
de Jazz de Montréal, L’Équipe Spectra Inc., L.L. Lozeau, and
Canon, or to their representatives and agents, affiliated companies, advertising
and promotional agencies, and promotional partners connected with this Contest,
or to any individuals having taken part in the design, production, or distribution
of the contest material, members of the selection committee (jury), or any members
of their immediate family (father, mother, brothers, sisters, and children) and
any individuals domiciled with the aforementioned.
HOW TO ENTER
NO PURCHASE NECESSARY
3. To submit a photo and enter the Contest,
you must first visit the outdoor site of the Festival International de Jazz de Montréal
between June 28, 2013 and July 4, 2013 and take a photo. To submit your photo, you
must then visit https://www.facebook.com/montrealjazzfest and click on the "PHOTO
Contest" tab on the home page. This will take you to the Contest page. Click on
the "Enter" tab. You will be redirected to an online registration form (http://www.montrealjazzfest.com/friends-of-the-festival/zoom-festival-contest.aspx).
Fill out the form by entering your last name, first name, email address, telephone
number (including the area code), city, and type of camera used. You must also check
off (√) the "I have read and accepted the contest rules" box and attach the
photo you wish to submit. Then click "Submit" to submit your entry form by no later
than 11:59 p.m. Eastern Daylight Time (EDT) on July 4, 2013.
3.1. If possible, keep the original photo with
the highest possible resolution for future promotional purposes.
3.2. On July 5, 2013, a jury comprised of representatives
of L.L. Lozeau will make a first selection of the 50 best photos based on entrant
eligibility, where the photo was taken (it must have been taken on the outdoor site
of the 2013 edition of the Festival International de Jazz de Montréal), and
the following technical and artistic criteria: visual impact, originality, relevance
to the proposed theme, and photographic processing.
The photographs selected during the first round will be presented in mosaic format
from 11:59 p.m. Eastern Daylight Time (EDT) on July 5, 2013 to 11:59 p.m. Eastern
Daylight Time (EDT) on July 7, 2013 on the Facebook application of our Facebook
page (https://www.facebook.com/montrealjazzfest).
3.3. Public vote. A voting period will be open
to the public from 11:59 p.m. Eastern Daylight Time (EDT) on July 5, 2013 to 11:59
p.m. Eastern Daylight Time (EDT) on 2
July 7, 2013. To vote, visit our Facebook page, click on the "Like" button, then
on the "PHOTO Contest" tabs. Choose your favourite photo and click on the "Vote"
button.
3.4. Jury vote. During a second round of selection,
which will take place on July 5, 2013, the jury will select the best photo from
among the 50 best photos based on the following criteria: visual impact, originality,
relevance to the proposed theme, and photographic processing.
4. LIMIT OF ONE (1) ENTRY PER PERSON AND/OR
EMAIL ADDRESS AND ONE (1) PHOTO. Multiple entries from the same person or same email
address will void all entries received from that person or email address,
5. All entries and photos submitted in this
Contest become the property of the Contest Organizer as soon as they have been transmitted.
6. By submitting your entry, you confirm that
your entry complies with all the terms set forth in these Rules. You hereby release
the Contest Organizer, as well as L’Équipe Spectra Inc., L.L. Lozeau,
and Canon, their representatives and agents, affiliated companies, advertising and
promotional agencies, promotional partners connected with this Contest, and any
other parties or interested persons otherwise associated with this Contest, from
all liability for any damages you may suffer as a result of use of your entry and
of any material submitted, if it is subsequently established that you did not fully
comply with the Rules of the Contest.
JURY PRIZE
7. Canon EOS 5D Mark III kit with 24-105mm
L IS (value: $3,899.99).
The Jury Prize will be awarded to the entrant who has submitted the photo selected
by the jury as the best photo.
PEOPLE’S CHOICE PRIZE
8. Canon EOS 6D kit with 24-70mm f/4 L (value:
$2,999.99).
The People’s Choice Prize will be awarded to the entrant whose photo receives
the most votes.
PHOTO SUBMISSION REQUIREMENTS
9. The following rules apply to the photos
submitted and the entrants, as the case may be:
9.1. Any photo submitted must be original (a
photo qualified as original was taken by the entrant and reflect his artistic expression.
It is not a copy, in whole or in part, of a photo that has been published elsewhere.
9.2. The photo must not contain any inappropriate
content, notably content that is sexually explicit, offensive, harassing, discriminatory,
libellous, violent, malicious, hateful, content that may offend the standards of
public decency prevailing in Québec society or that disparages the products
or services of the Contest Organizer, L’Équipe Spectra Inc., L.L. Lozeau,
Canon, their representatives and agents, affiliated companies, advertising or promotional
agencies, and promotional partners connected with the Contest. Nor shall the photo
contain any suggestive images promoting any illegal activities. 3
9.3. By participating in the Contest, each
entrant who submits a photo affirms, represents, and warrants that his photo:

has not been submitted in any other contest;

has not been submitted elsewhere for publication;

has not been published, rendered public, or been the subject of advertising;

has not won any prizes.
9.4. All submissions must be digital photos.
Montages or collages of several images by electronic means are not permitted.
9.5. Each entrant (a) declares and warrants
that his photo is an original work of which he is the sole author, and hereby waives
in favour of the Contest Organizer any and all moral rights he may have in relation
to his entry in respect of the uses mentioned herein; (b) warrants and agrees that
his photo does not infringe upon any person’s rights (including but not limited
to copyrights, trademarks, privacy rights, publicity rights, personal or other proprietary
rights, intellectual property rights, or civil rights); and (c) further agrees,
before being awarded any prize whatsoever, to sign the Declaration and Liability
Waiver form (the "Declaration Form") received from the Contest Organizer, notably
certifying the aforementioned points.
9.6. By entering the Contest, each entrant
grants the Contest Organizer the right to edit, adapt, publish, use, reproduce,
and distribute his photo worldwide and in perpetuity, without compensation of any
kind and for all forms of media, including but not limited to newspapers, books,
websites (including social media), and television channels.
9.7. All Entry forms and Declaration forms
become the property of the Contest Organizer.
9.8. Given the nature of this Contest and the
terms and conditions for entering and publishing the photos, it may be difficult
or impossible for the Contest Organizer to identify non-eligible content or content
for which the necessary permissions are not held. The Contest Organizer does not
require additional documents from entrants showing that they have obtained the necessary
permissions prior to publishing the photos. Consequently, if the photo submitted
does not comply with these Rules or if the Contest Organizer has reason to believe
that it is non-compliant, it reserves the right, in its sole discretion, to disqualify
the entry, remove part of the photo, or alter it in whole or in part, notably to
cover the elements concerned. If the photo is not published or is withdrawn, no
registration will be granted for this photo. No notice or explanation will be provided
to the entrant regarding the publication or not or the withdrawal of the photo submitted.
ODDS OF WINNING
10. The odds of winning depend on the total
number of valid entries recorded, the jury’s initial selection, the number
of votes (People’s Choice Prize), and the jury’s final selection (Jury
Prize).
GENERAL CONDITIONS
11. Online entry forms that are incomplete,
illegible, mutilated, reproduced, or submitted late will be declared null and void
and will result in disqualification. The Contest Organizer’s decision in this
regard is final and not subject to appeal. 4
12. The Contest Organizer reserves the right
to disqualify, or to cancel the entry or entries of, any person entering or trying
to enter this Contest by means contrary to these Rules or in a manner that is unfair
to the other entrants (e.g. using automated equipment to enter the contest, hacking,
or number of entries exceeding the limit allowed). Such persons may be reported
to the competent legal authorities. The Contest Organizer’s decision in this
regard is final and is not subject to appeal.
13. WARNING: ANY ATTEMPT BY
AN ENTRANT OR ANY OTHER PERSON TO DELIBERATELY DAMAGE THE WEBSITE, ALTER THE ENTRY
PROCESS, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST CONSTITUTES A VIOLATION
OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE CONTEST ORGANIZER
RESERVES THE RIGHT TO SEEK DAMAGES FROM SAID PERSON TO THE FULLEST EXTENT PERMITTED
BY LAW.
14. Prizes must be accepted as awarded, with
no warranties or guarantees implied or expressed. NO SUBSTITUTION OF PRIZES IS PERMITTED
EXCEPT BY THE CONTEST ORGANIZER AND IN ITS SOLE DISCRETION. The CONTEST ORGANIZER
RESERVES THE RIGHT TO SUBSTITUTE ANY PRIZE WITH ANOTHER PRIZE OF EQUAL OR GREATER
VALUE IF A PRIZE CANNOT BE AWARDED AS DESCRIBED FOR ANY REASON WHATSOEVER. PRIZES
ARE NON-TRANSFERABLE AND NOT REDEEMABLE FOR CASH OR CREDIT, IN WHOLE OR IN PART.
15. Entrants agree to comply with the official
Contest Rules and the decisions of the Contest Organizer, which are final and not
subject to appeal. This Contest is subject to all applicable laws. By entering the
Contest, entrants release and hold harmless the Contest Organizer, its advertising
agencies, and their respective affiliated companies, directors, officers, employees,
and agents, from any and all liability, loss, or damage of any kind arising from
or in connection with the Contest or for any prize won. In order to be declared
winners and before obtaining their prizes, the selected entrants will be required
to sign and return a Declaration and Liability Waiver from in this regard.
16. By entering the Contest, the entrants consent
to the disclosure, publication, or use of their names, place of residence, photograph,
or other likeness, without compensation or notice of any kind, for publicity, advertising,
or informational purposes in any media or format (including the Internet) in connection
with this Contest or similar future contests, and agree to and will sign any document
in respect of this undertaking or deemed necessary by the Contest Organizer.
17. Each selected entrant may be required to
provide the Contest Organizer with proof that he is the authorized account holder
of the email address associated with the selected entry forms.
18. The winners of the People’s Choice
Prize and of the Jury Prize will be announced on July 8, 2013. The names of the
winners will be announced and posted on July 8, 2013 on the Facebook pages of the
Contest Organizer and of L.L. Lozeau, as well as on the Contest’s Facebook
application. The names of the winners may also be mentioned at the Contest Organizer’s
results media conference or in its results news release.
19. For the purpose of these Contest Rules,
the entrant is considered to be the person whose contact information appears on
the online entry form. The Contest Organizer reserves the right to require a piece
of identification prior to remitting a prize.
20. In order to claim his prize, each winner
must (a) be reached by the Contest Organizer within fifteen (15) days of announcement
of the winners; (b) sign a Declaration and Liability Waiver form that he will receive
by regular mail, fax, or online, and return it to the Contest 5
Organizer within fifteen (15) days of receipt. Failure to comply with any one of
the aforementioned conditions shall result in the disqualification of the winner
and possibly a decision to refuse to award him the prize.
21. Any person selected for a prize acknowledges
that upon receipt of confirmation of his prize from the Contest Organizer, all services
to be rendered in connection with this prize become the sole responsibility of the
prize supplier.
22. If any section of these rules is declared
or deemed illegal, unenforceable, or invalid by a competent Court of Law, that section
will be considered null and void, but all other sections that are not affected will
be enforced to the extent permitted by law.
23. In the event of any discrepancy between
the French and English versions of these Rules, the French version will prevail.
LIMITATIONS OF LIABILITY
24. This Contest is in no way sponsored, endorsed,
administered by, or associated with Facebook. Any information that you provide in
this Contest is submitted to the Contest Organizer and not to Facebook, and will
be used only as stated in the Contest Rules. All participants fully release Facebook
from any and all liability. Any questions, suggestions, or complaints regarding
the Contest must be addressed to the Contest Organizer and not to Facebook.
25. Without limiting the generality of the
foregoing and for greater certainty, the Contest Organizer, L’Équipe
Spectra, L.L. Lozeau, Canon, and their affiliated companies, employees, agents and
representatives, advertising and promotional agencies, and promotional partners
connected with the Contest, shall not be liable for (i) any incorrect or inaccurate
information, whether caused by the Contest website users or by any equipment or
program utilized by the Contest or associated with it, or by any human or technical
error that may occur in the Contest entry process; (ii) any error, omission, interruption,
deletion, defect, or delay in operation of the website or any transmission in connection
with the Contest; (iii) any communication line failure, theft, destruction, or unauthorized
access to, or alteration of, entries; (iv) any problems with, or technical malfunction
of, any telephone network or line, computer online systems, services, or providers
of computer hardware or software, or failure of email which may occur due to technical
problems or traffic congestion on the Internet or at any website or any combination
thereof; or (v) any damage to a third party’s computer related to or resulting
from entering, or downloading material for, this Contest. If the Contest cannot
be run as planned for any reason whatsoever, including infection by computer viruses,
bugs, tampering, unauthorized intervention, fraud, technical failures, or any other
causes that corrupt or affect the administration, security, or proper conduct of
this Contest, the Contest Organizer reserves the right, in its sole discretion,
to cancel, terminate, modify, or suspend the Contest, subject to the approval of
the Régie des alcools, des courses et des jeux, if required. The Contest
Organizer, its affiliated companies, and the suppliers of prizes and services related
to this Contest may under no circumstances be held responsible to award more prizes
than those indicated in these Contest Rules otherwise than in compliance with these
Rules. Entering the Contest implies that you have consented to the Contest Rules,
notably with respect to the absolute limit on the number of prizes described above.
FOR QUEBEC RESIDENTS
26. Any litigation concerning the organization
or conduct of a promotional contest may be submitted to the Régie des alcools,
des courses et des jeux for a ruling. Any litigation respecting the awarding of
a prize may be submitted to the Régie solely for the purpose of helping the
parties reach a settlement. 6
27. The masculine form is used in this questionnaire
solely in the interests of readability with no discrimination intended.
PRIVACY
28. Personal information about entrants is
collected by the Contest Organizer for the sole purpose of administering this Contest.
Other informational or marketing communications may be received by the entrant unless
the entrant informs the Contest Organizer of his explicit refusal to receive such
communications. To obtain all information regarding the Contest Organizer’s
policy on the protection of user privacy and personal information, please see L’Équipe
Spectra’s Privacy Policy, to which the Contest Organizer subscribes, at http://www.infolettrespectra.ca/politique_confidentialite_fr.aspx.
You further agree that the Contest Organizer may disclose your personal information
to the companies responsible for providing us with specific services such as organizing
the Contest or managing the operations of our websites and databases or for other
reasons related to the operation of our business or of the Contest. The affiliated
companies are required to keep your personal information secure and confidential
and must respect our privacy policy. Their use of your personal information is always
restricted to the specific services to be carried out for us. Rest assured that
they categorically cannot share, sell, rent, or otherwise give your personal information
to anyone and must keep all information confidential, unless required by law.
